These Terms of Use (“Terms”) govern your access to and use of PinCam: GPS Map Photo Tag (“PinCam,” “the App,” “we,” “us,” or “our”).

By downloading, installing, accessing, purchasing a subscription to, or using PinCam, you agree to these Terms. If you do not agree to these Terms, you should not use the App.

1. About PinCam

PinCam is a GPS map camera and photo-tagging application that allows users to capture and create photos containing available location and environmental information.

Depending on the features available in the current version, PinCam may allow users to add information such as:

* GPS location

* Latitude and longitude

* Address

* Date and time

* Map information

* Altitude

* Compass direction

* Weather information

* Location accuracy

PinCam may be used for personal, travel, professional, construction, inspection, property, surveying, maintenance, delivery, fieldwork, and other documentation purposes.

Availability and accuracy of certain information may depend on device capabilities, permissions, GPS signal, internet connectivity, third-party services, and environmental conditions.

2. Eligibility

You may use PinCam only if you are legally permitted to enter into these Terms under the laws applicable to you.

If you use the App on behalf of a business or organization, you represent that you have authority to accept these Terms on behalf of that organization.

3. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use PinCam for lawful personal or business purposes.

You may not:

* Copy, modify, distribute, sell, rent, lease, sublicense, or commercially redistribute the App except where permitted by law.

* Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except where such restrictions are prohibited by applicable law.

* Attempt to bypass security, subscription, payment, or access-control mechanisms.

* Use the App to violate applicable laws or the rights of another person.

* Interfere with or disrupt the operation, servers, networks, or services associated with the App.

* Use automated systems to abuse or overload the App or associated services.

4. Location and GPS Information

PinCam uses location-related information to provide features such as GPS coordinates, maps, addresses, altitude, compass information, and location-based photo tags.

GPS, address, weather, altitude, map, compass, and similar information may not always be accurate.

Accuracy can be affected by:

* GPS signal strength

* Device hardware

* Location permissions

* Buildings or environmental conditions

* Network connectivity

* Map or geocoding services

* Weather-data providers

* Other third-party services

PinCam should not be treated as a certified surveying, navigation, emergency, engineering, legal, or safety system.

You are responsible for confirming important location information independently before relying upon it.

5. Photos and User Content

You retain ownership of photos and other content that you create or import using PinCam.

You are responsible for ensuring that you have the necessary rights and permissions to capture, edit, save, export, or share any content through the App.

Photos created with PinCam may contain visible or embedded information including location, address, GPS coordinates, date, time, or other metadata.

Before sharing a photo, you should review whether it contains information that you do not want to disclose publicly.

We are not responsible for how another person, platform, website, application, or service uses information that you voluntarily share.

6. Premium Features and Auto-Renewable Subscriptions

PinCam may offer premium features through auto-renewable subscriptions purchased through Apple's App Store.

Available subscription plans may include:

* PinCam Premium Weekly

* PinCam Premium Monthly

* PinCam Premium Yearly

The exact subscription price displayed to you may vary depending on your country, region, currency, applicable taxes, promotions, or pricing configured in Apple's App Store.

The applicable price and subscription duration will be displayed in the App before you confirm your purchase.

7. Subscription Billing and Automatic Renewal

Payment for a subscription will be charged to your Apple ID account when the purchase is confirmed.

Subscriptions automatically renew unless auto-renewal is turned off before the end of the current subscription period in accordance with Apple's applicable subscription rules.

Your Apple ID account will be charged for renewal according to the subscription plan and price shown by Apple.

You can manage or cancel your subscription through your Apple ID subscription settings.

Removing or uninstalling PinCam from your device does not automatically cancel an active subscription.

Subscription billing, renewals, cancellations, payment methods, and transaction processing are handled by Apple and are subject to Apple's applicable terms and policies.

8. Free Trials and Promotional Offers

PinCam may occasionally provide free trials, introductory offers, promotional offers, or discounted subscription pricing.

Where an offer is available, its duration, eligibility requirements, and the price charged after the promotional period will be shown before purchase.

Unless cancelled according to Apple's subscription rules, a promotional or trial subscription may automatically convert to the applicable paid subscription after the promotional period ends.

Eligibility for offers is determined according to the terms displayed at the time of purchase and Apple's applicable rules.

9. Subscription Cancellation

You may cancel an active subscription through your Apple ID subscription settings.

You can generally manage subscriptions by going to:

iPhone Settings → Apple ID → Subscriptions

Cancellation generally prevents the subscription from renewing for the next billing period. Access to premium features may continue until the end of the already-paid subscription period.

We cannot directly cancel an Apple App Store subscription on your behalf.

10. Refunds

Payments made through the Apple App Store are processed by Apple.

Refund requests for purchases made through Apple's App Store are therefore subject to Apple's refund policies and procedures.

We do not independently control Apple's refund decisions.

11. Restore Purchases

Where supported, users who previously purchased an eligible subscription or in-app purchase may use the App's Restore Purchases functionality.

Restoration depends on the Apple ID associated with the original purchase and Apple's transaction records.

12. Changes to Subscription Pricing or Features

We may modify subscription plans, pricing, premium features, or subscription availability where permitted by Apple and applicable law.

Any subscription price changes will be implemented according to Apple's applicable App Store requirements.

Where Apple requires user consent for a subscription price increase, the applicable Apple process will apply.

13. Free and Advertising-Supported Features

PinCam may provide free functionality supported by advertising.

Advertisements may be delivered by third-party advertising providers.

The availability, frequency, format, and placement of advertisements may change over time.

Premium subscriptions may remove certain advertisements or provide additional functionality where indicated in the App.

14. Permissions

Certain PinCam features may require access to device permissions, including:

* Camera

* Location

* Photo library

* Internet or network access

* Tracking permission where applicable

You may manage these permissions through your device settings.

Disabling a required permission may prevent the corresponding feature from operating correctly.

15. Third-Party Services

PinCam may depend on third-party platforms and services for functionality such as:

* Maps

* Geocoding and address information

* Weather information

* Analytics

* Crash reporting

* Advertising

* App Store payments

* Subscription processing

* Device functionality

Third-party services operate according to their own terms and privacy policies.

We do not guarantee that a third-party service will always remain available, accurate, or unchanged.

16. Acceptable Use

You agree not to use PinCam:

* For unlawful, fraudulent, deceptive, or abusive purposes.

* To violate another person's privacy, intellectual property, or other legal rights.

* To capture or distribute content where doing so is prohibited by law.

* To intentionally misrepresent GPS, address, date, time, or other information for fraudulent purposes.

* To interfere with the operation or security of the App.

* To circumvent subscription or payment systems.

* To distribute malware or malicious content.

* In any manner that could harm PinCam, its users, or third parties.

We may restrict access to the App where reasonably necessary to prevent fraud, abuse, security threats, or unlawful activity.

17. Accuracy of Information

Location, GPS, maps, addresses, altitude, weather, compass information, timestamps, and similar information provided through PinCam are provided for convenience and informational purposes.

We do not guarantee that this information will always be complete, current, or accurate.

PinCam is not intended to replace professional surveying equipment, certified measurement systems, emergency-navigation tools, or official geographic records.

Users are responsible for independently verifying information where accuracy is important.

18. Availability and Changes to the App

We may update, improve, modify, suspend, remove, or discontinue certain App features from time to time.

Some updates may be necessary for:

* Security

* Compatibility

* Legal compliance

* App Store requirements

* Third-party service changes

* Bug fixes

* Performance improvements

We do not guarantee that every feature will remain available indefinitely.

19. Intellectual Property

The PinCam application, including its software, branding, designs, graphics, interfaces, icons, logos, and other materials provided by us, is protected by applicable intellectual-property laws.

Except for the limited right to use the App provided under these Terms, no ownership rights are transferred to you.

Third-party trademarks and services remain the property of their respective owners.

Your use of PinCam is also subject to our Privacy Policy:

The Privacy Policy explains how information may be accessed, used, processed, and shared in connection with the App.

21. Disclaimer of Warranties

To the maximum extent permitted by applicable law, PinCam is provided on an “as is” and “as available” basis.

We do not guarantee that:

* The App will always operate without interruption.

* The App will be error-free.

* GPS or location information will always be accurate.

* Maps, addresses, weather, altitude, or compass data will always be available.

* The App will meet every user's individual requirements.

* Third-party services will remain continuously available.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded under applicable law.

22. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or similar damages resulting from the use of or inability to use PinCam.

This includes losses arising from reliance on inaccurate GPS, map, weather, altitude, address, location, compass, timestamp, or other information.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

23. Apple-Specific Terms

If you download PinCam through Apple's App Store, you acknowledge that these Terms are between you and the developer of PinCam and not with Apple.

Apple is not responsible for providing maintenance or support services for PinCam except as required by applicable law.

If PinCam fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple's applicable policies.

Apple is not responsible for addressing claims relating to the App or your possession and use of the App except where required by applicable law.

You must comply with the applicable Apple Media Services Terms and App Store rules when using PinCam.

Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the App distributed through the App Store and may enforce applicable provisions against you.

24. Termination

These Terms remain effective while you use PinCam.

You may stop using the App at any time.

We may suspend or terminate access to certain services if you materially violate these Terms, abuse the App, engage in fraudulent activity, or create a security or legal risk.

Termination of access to the App does not automatically cancel an Apple subscription. Subscriptions must be managed through Apple according to Apple's subscription-management procedures.

25. Changes to These Terms

We may update these Terms from time to time to reflect:

* Changes to PinCam

* New features or services

* Subscription changes

* Legal requirements

* App Store requirements

* Security or operational requirements

When these Terms are updated, the revised version will display an updated “Last Updated” date.

Your continued use of PinCam after an updated version becomes effective constitutes acceptance of the updated Terms where permitted by applicable law.

26. Governing Law

These Terms will be governed by applicable laws, subject to any mandatory consumer-protection rights available in your country or region.

Nothing in these Terms removes rights that cannot legally be waived under applicable consumer law.
